Legal Flash : Brexit – UK citizens Staying in the EU for more than 90 days

By 22/01/2021 No Comments

Upon the end of the transition period on the 31st of December 2020, all British citizens wishing to either travel or reside in the EU will have to abide by the general rule for non-Eu citizens, stipulating that they can do so for no more than 90 days out of every 180 days, without needing to issue Visas or Residence Cards.

It is worth noting that once the 90-day period is over, British, as well as any other non-EU citizen cannot enter in any of the Member-States until the 180-day period since the first entrance in EU soil has elapsed.

To stay for longer, work, study or for business purposes in Greece, UK nationals who are not covered by the Withdrawal Agreement will need to meet the entry requirements set out by the Greek Immigration Code.

As is evident, such a provision poses major difficulties to British citizens owning real-estate property in EU territory who wish to stay there for a longer period of time. Nonetheless, especially in the case of Greece, an extremely popular destination for British home owners, there are solutions to circumvent this problem.

Greece, in addition to being among the most preferred destinations to purchase a vacation home or even reside permanently, is offering options to both real estate owners, as well as pensioners and passive income earners, as financially independent people.

For anyone wishing to purchase real estate in Greece, the country is offering the Golden Visa Residence Program, granting a Residence Card, valid for 5 years, that can be renewed, to individuals purchasing real-estate of a value of at least €250.000 in Greece.

By obtaining this card, British citizens will from that moment onward be entitled to stay in Greece for as long as they desire, provided the Golden Visa remains valid, as well as travelling in the same way as EU citizens. It is worth noting that the Golden Visa does not grant the right to reside in other Member States, but only to travel under the same terms as EU citizens (For more information about the Golden Visa Program, you can visit https://www.law-services.gr/golden-visa-in-greece/).

With the predictions forecasting an increase of available properties and a decrease in prices (For more information, you can also read https://www.law-services.gr/legal-articles-and-media/real-estate-investments-in-greece-during-the-covid-19-pandemic/), it seems that opting for the Golden Visa program is more profitable than ever.
